Clery Act of 1990

In efforts to increase safety on campus and adhere to federal regulations, Utica University complies with the policies laid out in the Clery Act of 1990. The Clery act dictates that campus crime must be reported annually, to ensure that the community is informed and alert to situations occurring on campus, or at campus sponsored events. A key component to this legislature is the cooperation from individuals on campus, in reporting crimes, suspicious activity, and perceived threats.

Campus Security Authorities

Campus Security Authorities are individuals on campus who work closely with the students, staff, and other community members. These individuals are required, by law, to report crime to the safety authority on campus. As mandated reporters these individuals help alert Campus Safety to crime on campus, and respond with appropriate action.

If you receive a report of a Clery reportable crime (as defined on pages 2 and 3 of the form), please complete and submit the Reporting Form immediately.
If you receive no reports of Clery reportable crimes, please complete and submit the Reporting Form annually.

What if I am unsure if an incident is a crime? Or if it should be reported under Clery?

It is ALWAYS better to notify Campus Safety, than to withhold information that could potentially endanger individuals of the school community. We are available 24/7, and can investigate incidents to determine the appropriate course of action.

Individuals who are exempt from crime reporting:

Some campus officials, due to the nature of their work and qualifications, are not required to report crime. While these individuals are strongly encouraged to notify campus safety, they are also entitled to respect the privacy of students and/or staff who come to them in confidence.

What happens if I do not report criminal incidents to Utica University Campus Safety?

Because the Clery act is federal law, there may be extensive civil penalties for failing to report crime. In addition, the consequences of withholding information can be dangerous and severe, when people are put at unnecessary risk that could have been prevented.

When must I register trips to off-campus locations?

If the university makes the arrangements, pays for, and has an agreement with the lodging location the trip is considered university-sponsored.

Overnight, university-sponsored trips: If the university or registered student organization sponsors student(s) on an overnight trip, for example, to see a play in New York City, and the department rents hotel rooms.
Short-stay "away" trips: If the university or registered student organization sponsors short-stay "away" trips of its students, hotel rooms used to support educational purposes should be registered. An example is a three-week marine biology study trip to Florida. Any classroom or housing space specified in the agreement between the institution and a third-party providing space is reportable.
Athletic Department or Club Sports Trips: When an athletic team under the control of the Athletic Department or a club sports team under the control of Club Sports, stays at a hotel it is reportable.
Third-party contractor: If the university has entered into a written agreement with a third-party contractor to arrange housing and/or classroom space for a university-sponsored trip or study program (either domestic or foreign), it is assumed that the contractor is acting on behalf of the school as the school's agent, putting the institution in control of this space, so the trip is reportable.
Study abroad programs: For students studying abroad at locations where facilities are rented or leased through the university or a third-party contractor, the location is reportable.

What does not need to be registered as an off-campus trip?

If students make the arrangements choose and pay for the hotel, it is NOT a university-sponsored trip.

Field Trips: You are NOT required to register non-overnight field trips to locations the university does not own or control.
Host family situations do not normally qualify as reportable locations unless your written agreement with the family gives the university/department significant control over space in the family home.

Registering Your Trip

Any faculty, staff, or volunteer who leads the trip or travels along and has responsibility for the students during the trip are considered Campus Security Authorities. This person should fill out the Campus Security Authority Student Travel Form (Note: form will be posted soon - contact us for more information).

As part of the Clery Act, those identified as CSA's must undergo training. Provided here is the pre-test, training materials, and a post-test. Please take the pre-test first, then review the training materials, and complete the post-test.

Campus Hazing Transparency Report

Per the Stop Campus Hazing Act, Utica University will compile and publish relevant and pertinent information regarding each incident of hazing for which a recognized student organization was found responsible. Beginning July 1, 2025; this information will be collected and subsequently published/ updated twice each year. (January 1 and July 1)

Utica University encourages the reporting of incidents of hazing and takes each report seriously. It will investigate all reports diligently and thoroughly. In accordance with the Stop Campus hazing Act, any person may report an incident of hazing in person, by mail, by telephone or electronic mail using the contact listed for Campus Safety at (315) 792-3046 or by utilizing Utica University's reporting system at https://utica.guardianconduct.com/incident-reporting/new.
